I thought at first that it might be the MAX but I have written VCD's at a CBR of 3300 and it worked fine.
The standalone is a Toshiba SD1200. I really don't like it and am planning on replacing it. What bugs me is why it works perfectly sometimes and then not others.

You don't need that MIN set so high
I would set MIN=300 to 400, MAX no more that 1,800. This way your encoding will be more space efficient. 1,800 is close to the MAX bit rate in what's called the CPB ( Constrained Parameter Bitstream ) which defines a limited set of sampling and bit rate parameters for MPEG-1. I believe that most (almost all) standalone DVD players that handle VCD follow this set, instead of being rigid at only VCD specifications. These parameters are:

Horizontal Resolution: <= 768 samples
Vertical Resolution: <=576 scan lines
Picture area: <=396 macroblocks
Pel rate: <=396 X 25 macroblocks per second
picture rate: <= 30 frames per sescond
bit rate: <= 1,856 Kbps
So you see, your bit rate variations up to MAX bit rate could be causing the problems, and throwing off sync in the decoder chip in your DVD player. Try to stay below 1,800Kbps at 352x240.
