WOO HOO finally sorted it all, authored through DVDMaestro and burned through DVDShrink as the total filesize was over 5 gigs but hey it all worked out an I got me subs only problem is they aren't forced subs showing automatically have to select the subs manually.

You have to check "forced display" in each forced subs in maestro to display them.

where is that option in Maestro?? and how do I do that?

On the subtitle line, you right click on a forced sub, select edit and check the "forced display" box, repeat for every forced sub.
