KVCD: converting 23fps to 29.976fps causes audio sync errors?

to properly play kvcd3 on my apex player I needed to change the resolution to 480x480 on my movies. I noticed some jerkiness so I upped the fps to 29.976. now when it plays smooth, but the audio is out of sync onthe apex and even on my pc. anyone know how to properly convert ?

on another note, I have a problem in tmpgenc with a script, I keep getting

LegalClip: Source must be YUY2 [any suggestions]?

Add "ConvertToYUY2()" just before the first Legalclip()
