Well in the header ... you just "tell" the player what he probably will get!
But you cant change the max rate after encoding (as you know) ... so do burn a sample DVD-RW...

Use "Restream" or "DVDpatcher" ... ... and...

... and patch the header so the decribed bitrate wont be over 9800kbit ;-)

But as I now, what will be written in the header is the SAME which is set in...
