Hmm, IMHO the difference comes from the fact that ColorYUV outputs the text over the existing video which then alters the histogram.

Scaling isn't the option to use every time. I just did a small test on my latest capture file which reportedly has values over 235.

At least that's what the manual says so I would expect it to be that way. The range is used for converting from RGB to YUY2 in which the encoder works internally.
