the only way I could do it is mux the m2v, ac3 subtitle file and chapter points in ifoedit then I copied and pasted the subtitle colours so the subs looked right, I then re-authored in dvdshrink and then burned them off to dvd as 2 tracks no menus where done in the process (sadly).
